Terms of Service

1. Agreement

By creating a DMflux account, you agree to these Terms of Service. These terms constitute a binding agreement between you and Qorv LTD.

2. The Service

DMflux provides WhatsApp campaign tracking, analytics, and reporting tools for WhatsApp TV, influencers, businesses, and marketers. Features vary by subscription tier (Starter, Growth, Agency).

3. Account Responsibilities

• —You are responsible for maintaining the security of your account credentials
• —You must provide accurate information during registration
• —Each account belongs to one individual or organization. Plans that support team access may permit authorized members of that organization to use the account.
• —You must be at least 18 years old to use DMflux

4. Acceptable Use

You agree NOT to use DMflux to:

• —Track campaigns promoting illegal products or services
• —Link to phishing pages, scams, or impersonation of any person or brand
• —Send spam or unsolicited messages
• —Attempt to reverse-engineer or scrape the platform
• —Share your account credentials with unauthorized parties
• —Use tracking links to mislead or deceive ad recipients

Violation of these terms may result in disabling the offending tracking link (visitors receive a “campaign ended” page) and/or immediate account suspension without refund. To report a tracking link that violates these terms, email dmflux.labs@gmail.com with the link; we aim to review credible abuse reports promptly and may temporarily disable a tracking link while a report is investigated.

5. Subscription and Billing

• —Paid subscriptions are billed monthly or annually, depending on the billing period selected at checkout, and are processed via Paystack
• —Payment is due at the start of each billing cycle
• —If payment fails, your account enters a 3-day grace period before downgrading to the Free plan
• —You may cancel your subscription at any time; your paid features remain active until the end of the current billing period

5A. Launch Prices

Customers who join during the launch period keep their launch price for as long as the account remains in good standing and the subscription is not cancelled. If a subscription lapses (for example, because payment fails and the grace period ends), the launch price is forfeited and the account reverts to the then-current standard price upon resubscription. We will always tell you the price before you are charged; if the standard price changes, we will notify you before your next renewal.

6. Refund Policy

All subscription payments are non-refundable. We do not offer partial refunds for unused periods. If you believe you have been charged in error, contact dmflux.labs@gmail.com within 7 days.

7. Data, Privacy, and Processing

Your use of DMflux is subject to our Privacy Policy, which is incorporated into these Terms by reference.

Where DMflux processes personal data on your behalf as a processor, the Data Processing Agreement at dmflux.app/dpa applies and is incorporated into these Terms by reference.

8. Intellectual Property

DMflux, its logo, and all platform content are owned by Qorv LTD. You retain ownership of your campaign data. By using DMflux, you grant us a limited licence to process your data solely to provide the service.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law, Qorv LTD shall not be liable for:

• —Indirect, incidental, or consequential damages
• —Loss of revenue or profits arising from campaign performance
• —Service interruptions beyond our reasonable control

Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on severity of the violation.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.

13. Changes to Terms

We will notify users of material changes via email at least 14 days before they take effect. Continued use of DMflux after changes constitutes acceptance.
